1. Purpose and Relationship to the Terms of Service
This Acceptable Use Policy (“AUP”) governs use of the TapKit platform, including the TapKit API, macOS application, and all related services (the “Service”), provided by Jootsing Research Inc. This AUP is incorporated into and forms part of the TapKit Terms of Service (the “Terms”), and capitalized terms not defined here have the meanings given in the Terms. A violation of this AUP is a material breach of the Terms.
This AUP applies to all use of the Service under your Account, including use by Authorized Users and use initiated by software — including AI assistants and agent frameworks — acting on your behalf. You are responsible for automated and agent-initiated activity under your Account to the same extent as if you had performed it yourself.
3. Prohibited Uses
You must not use the Service, directly or through any Third-Party Client, to engage in any of the following.
3.1 Illegal Activity
Violating any applicable local, state, national, or international law or regulation, or advocating, facilitating, or assisting others in doing so.
3.2 Fraud, Impersonation, and Platform Manipulation
- Engaging in any activity that is fraudulent, deceptive, or misleading;
- Creating fake or misrepresented accounts on Third-Party Applications, or operating accounts in violation of a platform’s identity or registration requirements;
- Generating artificial engagement or manipulating metrics, rankings, reviews, ratings, or analytics on any platform;
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity;
- Committing advertising fraud, click fraud, or payment fraud.
3.3 Unsolicited Communications
Sending unsolicited messages, spam, or bulk communications through Third-Party Applications, or otherwise using the Service in violation of applicable communications and anti-spam laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act, and analogous state laws.
3.4 Data Harvesting and Restricted Data
- Harvesting, scraping, or collecting personal information of individuals without their consent or another lawful basis, or in violation of applicable privacy laws;
- Stealing, harvesting, disclosing, or misusing login credentials, passwords, one-time passcodes, authentication tokens, payment details, or other sensitive information without authorization. This does not prohibit processing information necessary for a lawful, authorized workflow, such as signing in, retrieving a verification code, or completing an authorized checkout, as permitted by Section 5.3 of the Terms;
- Submitting Restricted Data or directing workflows that process Restricted Data in violation of Section 5.3 of the Terms. The authorized credential and payment workflows permitted by that section remain permitted under this AUP.
3.5 Security Violations
- Distributing malware, viruses, or other harmful code;
- Interfering with, disrupting, or attempting to gain unauthorized access to any systems, networks, services, or accounts;
- Circumventing or attempting to circumvent any security, rate-limiting, or access control mechanisms of the Service or any Third-Party Application;
- Conducting denial-of-service attacks or otherwise overburdening any system;
- Conducting security testing of the Service or any Third-Party Application without prior written authorization.
3.6 Evasion of Platform Enforcement
Using the Service to circumvent an account restriction, suspension, ban, or other enforcement action imposed by a Third-Party Application, or to misrepresent automated activity as human activity where a platform or applicable law requires automation to be disclosed.
3.7 Harmful and Exploitative Content
Using the Service in connection with child sexual abuse or exploitation material of any kind (we will report violations to the National Center for Missing & Exploited Children and law enforcement); or to harass, threaten, stalk, or intimidate any person, or to incite violence.
3.8 High-Risk Activities
Using the Service in any application or environment where failure or malfunction could foreseeably lead to death, personal injury, or severe physical or environmental damage, or as a component of any safety-critical system.
3.9 Service Integrity
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying technology of the Service, except to the extent such restriction is prohibited by law;
- Using the Service to develop a competing product or service, or benchmarking the Service for competitive purposes without TapKit’s prior written consent;
- Sublicensing, reselling, leasing, or otherwise making the Service available to any third party, except as expressly permitted under your subscription plan;
- Sharing Account credentials or API keys in violation of the Terms;
- Using the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of the Service.
4. Third-Party Application Terms
You are solely responsible for your compliance with the terms of service, acceptable use policies, and other agreements of any Third-Party Application you access or interact with through the Service, whether through a Skill or otherwise. TapKit does not monitor, enforce, or make any representations regarding the terms of Third-Party Applications, and has no liability for consequences arising from your interactions with them, including account restrictions, suspensions, or bans imposed by third-party providers.
5. Enforcement
We may investigate suspected violations of this AUP and may suspend or terminate your access to the Service immediately and without prior notice for violations, as provided in Section 9.5 of the Terms. We may also remove or disable content, revoke API keys, notify affected third parties, and report activity to law enforcement where we believe in good faith that the law requires or permits it. We have no obligation to monitor use of the Service, and our forbearance from enforcement in one instance is not a waiver in any other.
6. Reporting Violations
To report suspected violations of this AUP or security vulnerabilities, contact support@tapkit.ai.
7. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated in accordance with the Terms, and continued use of the Service after the effective date of an updated AUP constitutes acceptance of the changes.
